“Biased?  Who, Me?!?”  A Candid Look at the Problem of Implicit Bias and Its Implications for Diversity, Equity, and Inclusion

Unconscious, implicit biases exist in all of us to varying degrees. They are difficult to detect, but can have an enormous impact on how we react to people based on their race, gender, sexual orientation, and other factors. Social psychologists have developed a body of research in recent years that provides insight into our biases and the reasons why our minds are prone to developing mental shortcuts and, in particular, negative associations regarding people who are different from us. This workshop will explore (a) the origins of biases, (b) how they can be measured, (c) how these biases impact our efforts at diversity, equity, and inclusion, and (d) how we can counteract both personal and societal biases. The workshop will be highly interactive, with opportunities for small group discussion and experiential exercises.

DAVID A. HOFFMAN

David A. Hoffman, Esq. is the John H. Watson, Jr. Lecturer on Law at Harvard Law School, where he teaches courses on Collaborative Law, Mediation, and Diversity. He also serves as a mediator, arbitrator and Collaborative Law attorney at Boston Law Collaborative, LLC. He was a founding member of the Massachusetts Collaborative Law Council and a former chair of the American Bar Association Section of Dispute Resolution. David has published three books and numerous articles on dispute resolution and has led trainings on implicit bias, diversity, equity, and inclusion nationally and internationally. David and his wife Leslie Warner live in a cohousing community in Acton, Massachusetts. They have five adult children and an adolescent cat. More info about David can be found at www.blc.law.

“Biased? Who, Me?!?” A Candid Look at the Problem of Implicit Bias and Its Implications for Diversity, Equity, and Inclusion

  1. Welcome, Agenda Review, Ground Rules, and Introductions (20 minutes): participants will each very briefly introduce themselves and explain (in the Chat function) why they have signed up for this workshop, followed by a poll, and a brief overview of what we mean by implicit bias, diversity, equity, and inclusion.
  2. Warm-up Exercise: Social Identity Circle (30 minutes): participants take turns stating an identity that is not apparent, and the other attendees join in the Zoom ‘circle’ if they share that identity.
  3. Stereotyping Exercise (25 minutes). Each participant will fill out a worksheet in which we consider the ways in which each of us has been subjected to a stereotype of some kind, and explore how we feel about those stereotypes. The purpose of this exercise is to open participants more fully to the idea that we are not only subjected to stereotypes, but also carry around stereotypes of various kinds about other people.
  4. Defining Implicit Bias (20 minutes). We will look at unconscious bias through the lens of research about mental shortcuts that our brains are hardwired to make – akin to ‘priming’ and subliminal messaging. We will also consider the reasons why recognizing implicit bias is challenging.
  5. Break (10 minutes)
  6. Taking the Implicit Association Test (30 minutes). We will do a version of the test in real time via Zoom, and then discuss how people felt about their responses – first in small breakout rooms, and then in a plenary session.
  7. The Impact of Implicit Bias (30 minutes). A review of two types of impact – interpersonal (in the form of microaggressions) and systemic (in the form of adverse outcomes in health, education, employment, housing, and the criminal justice system), with small group discussion in breakout rooms.
  8. Q&A and Concluding Remarks (15 minutes) – homework for next session: (a) Google techniques for counteracting bias and bring one or two to the next session, and (b) think of a ‘prompt’ for the Privilege Walk.

  1. Welcome, Agenda Review, and Reminder about Ground Rules (10 minutes)
  2. Counteracting Implicit Bias – Personal and Systemic (50 minutes). A review of techniques for reducing both personal bias and also systemic / institutional bias, plus small group discussion of those techniques.
  3. Privilege Walk (45 minutes). Using prompts created by the attendees on Day One, we will do an online version of this exercise, to measure (anonymously) our unearned advantages and disadvantages, with polling to show the results, and then small group discussion about the implications
  4. Break (10 minutes)
  5. Bringing It All Back Home (45 minutes) – What can we do in our professional practices, our Collaborative Practice Groups, and in our lives outside of work to counteract bias and increase diversity, equity, and inclusion? Large group brainstorming, then small group discussion to explore next steps.
  6. Q & A and Concluding Remarks (20 minutes)

Virtual Cocktail Reception with "Variety" Talent and Entertainment 

Our virtual reception theme will be "2020" since this has been such a momentous year for all of us. Because we have really talented folks in our membership, part of our reception will be a "Variety Show" prerecorded on the Tribute Website where you easily submit your videos.  Tell a little story, sing a song, share a recipe in a quick cooking entry, do something funny and original to showcase your talent for your own five minutes of fame!  Pandemic outfit changes, special tips on how to look great on Zoom (from the waist up).....be fun, be original, say something meaningful!  You can either record directly onto the Tribute site, or you can record your video on your own device and upload it.  The NYACP Annual Meeting Tribute page is https://www.tribute.co/annual-nyacp-meeting/. Spouses are welcome to join in!  
Deadline to submit a video is November 20th, the week before Thanksgiving.
